Services: Public Owner; Prime Contractor; Small Business
If you represent a public owner, we can help you cost effectively serve your governing body and public
constituents, by providing the following services:

a.        Help you develop and implement a
Lean Construction initiative for your agency, including
coaching your leadership and staff on ways to help make the cultural change necessary to make the
Lean initiative sustainable.

b.        Develop a
procurement strategy and process, which meets your technical, legal and social
objectives.  We can do this for a single project or a whole program.  This helps you achieve your
objectives within the constraints of your legal authority, while making your project more attractive to
bidders.

c.
Review a contract and compare its terms and conditions to “best practices” in risk sharing,
contract administration procedures, dispute resolution and so forth.  This helps you get better bids
because your contract documents will be more competitive.

d.        Develop and execute a public
involvement process for a construction project.  This helps you not
only fulfill the legal requirements for community participation, but enhances your reputation as a
responsive agency and helps you collect valuable information from a broad cross-section of people.

e.        Develop and implement a
“project partnering” program for your project to prevent claims.  This
helps you identify and resolve disputes before they become claims or worse, lawsuits.  It helps keep the
communication, which is necessary to solve problems, alive on a project.

f.        Analyze and pursue
contract claims.  This helps you defend your agency from claims and hold
contractors accountable for their failures to comply with their contracts.

g.        Engage in
dispute resolution, including: mediation, arbitration and litigation. This helps you
resolve a dispute with the least expense and stress as possible.

h.        Legal and technical
research and writing. This helps you leverage your in-house staff and
available budget by having access to specialized expertise on an on-call basis.

i.        Engage in
organizational development improvements, including policy development.  This helps
you cost effectively apply industry “best practices” to your agency operations to stay current and innovative
as well as foster an environment of continuous learning and improvement.

j.        Engage in
strategic planning required to support agency policy.  This helps you stay focused on
your mission by rising above the frantic day-to-day operations and thinking through long term and short
term planning.

k.
Teaching your management and staff about “best practices” related to contracts, procurement,
small business inclusion and public involvement.  This helps you keep your staff current, motivated and
responsive.
